Home Snappers' Terms of Service

Ah, terms of service - not the most riveting topic you can think of, but a necessary one. So, what is "Terms of Service"? Terms of Service is basically a contract between Home Snappers and our clients. This agreement ensures that we both hold up our end of the bargain. 

Below are our official Terms of Service. They can also be found at the foot of our website along with our Privacy Policy. 

Acceptance of Terms and Conditions:

The present terms and conditions (this "Agreement" or "Terms") is a legal agreement made between HOME SNAPPERS Real Estate Photography (hereinafter "Home Snappers"), a company duly organized and validly existing, located at 638 U.S. 67 Frontage Road, Duncanville, Texas, 75137 and Client(s) ("Clients"). All contracts and transactions between the Home Snappers and Client whether made orally or in writing are subject to these terms and conditions which shall be deemed to be incorporated into any contract between Home Snappers and all its Clients.

  1. DESCRIPTION OF SERVICES

    Home Snappers will provide to the Client the following photography services (collectively, the "Services"):

    • The Photographer agrees to take photographs per the Client's stated requests, allowing for artistic expression;
    • The Photographer agrees to use high technical quality to meet the Client's needs for web or print;
    • The Photographer will use digital photography and color management consultancy knowledge to create photographs for the Client; and
    • Home Snappers shall provide the Client with the final proofs within 2 days.
    • Home Snappers agrees to perform Post Production Editing prior to photo delivery.
  2. POST-PRODUCTION EDITING

    2.1 Photographs. All photo packages shall include basic professional editing services as follows:

    • Changing image saturation, brightness, contrast, or color balance
    • Fixing converging verticals, lens barrel distortion, or color fringing
    • Sky replacement or enhancement
      Home Snappers will upgrade exterior photos taken on an overcast day to Blue Sky. If new outdoor shots are needed, Client should make a Seasonal Update appointment
    • Greening of the existing grass and NOT adding grass
    • Removing minor visual clutter and temporary objects such as power cords, garbage cans, toys, etc.

    Street trash removal, fixture lighting, paint patching, and glare removal are NOT considered basic photo editing, it is defined as additional editing. Additional editing shall be requested within 7 days of the original shoot at no additional charge. Additional edit requested outside of the 7-day period from original photo sample delivery is subject to an additional editing fee of $5 per photo.

    In accordance with the REALTORS® Code of Ethics & Arbitration Manual to be honest and truthful in their real estate communications and present a true picture in their advertising, marketing, and other representations; the following edits shall not and cannot be made to the photos if requested changes are not being made to the property prior to closing.

    • Removal of holes, cracks, or stains on walls, carpet, or cement.
    • Inserting grass, trees, or landscaping where it does not exist
    • Removal of power lines, power boxes, telephone poles, surrounding structures, etc.
    • Removal or alterations of any permanent structures, fixtures or obstructions on or surrounding the property.

    2.2 Video. All video packages shall include professional editing as follows:

    • Changing video saturation, brightness, contrast or color balance
    • Fixing converging verticals, lens barrel distortion or color fringing
    • Motion stabilization

    2.3 Additional Shots. Requested by the Client to satisfy Home Snapper's "Satisfaction Guarantee" per management approval.

  3. SCHEDULING, RESCHEDULING AND CANCELATION

    3.1 Scheduling. Client shall provide Home Snappers with a credit card to put on file at the time of reserving an appointment slot. The card will not be charged until services have been completed unless cancelation or rescheduling fees are necessary.

    Once services have been completed and media has passed the quality control check, the credit card on file shall be charged for the total invoice amount. Requested services not rendered, shall not be charged on the final invoice.

    Properties located outside a 50-minute radius from Home Snappers' central location in Dallas shall require a trip charge.

    Photographers shall wait for a maximum of 15 minutes at the photoshoot before they must start the shoot if additional prep work is required by the Client. The remaining preparation should be completed within the first 15 minutes of the Photographer's arrival to avoid being charged a penalty fee

    Client shall not split photo packages between different addresses. Separate addresses shall require an individual appointment reservation.

    3.2 Rescheduling/Canceling. If rescheduling and/or canceling of the photography shoot by the Client is done:

    • less than 24 hours prior to the commencement of the shoot, a $25 rescheduling/cancelation fee shall be charged to the credit card on file;
    • less than 12 hours prior to the commencement of the shoot, a $50 rescheduling/cancelation fee shall be charged to the credit card on file;
    • less than 1 hour prior to the commencement of the shoot, a $99 rescheduling/cancelation fee shall be charged to the credit card on file;

    Important: If the initial appointment included a Trip Charge, a rescheduling/cancelation fee will be charged plus the Trip Charge to the credit card on file.

    3.3 Client Cancelations and Inclement Weather

    Should any event occur that delays, disrupts, or cancels the photography shoot, which is outside of the control of the Client or Photographer, the shoot may be rescheduled without fee or penalty within a 12-hour window of the appointment. On the day of the photography shoot, the Client may opt to reschedule the shoot due to inclement weather no later than 1 hour prior to the scheduled appointment. Rescheduling within 1 hour of the appointment will result in a $99 cancelation fee being charged to the card on file. No fee or penalty shall be incurred by any Party should the shoot need to be rescheduled an hour prior to the appointment due to inclement weather.

    FORCE MAJEURE EVENTS:
    Neither Home Snappers nor the Client shall be held liable for failure or delay in the performance obligations where such performance is delayed or hindered by the occurrence of an unforeseeable act or event which is beyond the reasonable control of either party. Force Majeure Events include but are not limited to all reasonably unusual and unanticipated events, Acts of God (such as server acts of nature or weather events including but not limited to floods, fires, earthquakes, hurricanes, or explosions), war, acts of terrorism and epidemics, government intervention, directives or policies. The party affected by a Force Majeure Event shall notify the other as soon as reasonably practicable.

    In the event, the Client chooses to keep the appointment regardless of the inclement weather, the following shall apply:

    • Photography. The Photographer shall photograph the interior and exterior of the home with digital replacement of the skies for the exterior photos. Due to severe weather, the Photographer on-site can choose to reschedule the exterior pictures at a later date with no additional charge to the Client.
    • Videography. The Photographer shall reschedule exterior shots due to overcast or rain (if applicable). Video cannot be edited to remove rain and overcast background as it will be reflected in the video. A $99 return fee to shoot the exterior shall be charged to the credit card on file.
    • Aerial Photography and Videography: The Photographer shall reschedule the aerial photography and/or videography due to rain at no charge. Drones will not be operated in rain, snow, or winds exceeding 20 mph.
    • 3D Interactive Matterport Tour: The Photographer shall advise (when applicable) to reschedule if the main selling feature of the property or unit is compromised by the weather conditions visible through the windows.

    Home Snappers shall not provide free expedited turnaround for delays caused by weather.

    3.4 Home Snappers Cancelation. All video packages shall include professional editing as follows:
    Home Snappers shall maintain the right to cancel an appointment upon arrival on-site for the following, but not limited to scenarios:

    • Unable to gain access to the property. The Photographer shall reach out to the provided contacts for the appointment via text and phone call. If unable to gain access to the property within 15 minutes of the scheduled appointment
    • The Photographer deems the property "not photo-ready" due to interior and exterior repairs, installments, cleaning, staging, landscaping, uncleared excess clutter not completed prior to the Photographer's arrival. Remaining preparation shall be completed within the first 15 minutes of the Photographer's arrival. If the Client wishes to proceed, the Photographer must be able to begin servicing the property within 15 minutes of the scheduled appointment time. Areas with excess clutter or unfinished work will be omitted.
    • The property is without electricity. As a courtesy, the Photographer shall attempt to contact the Client via phone to notify them, and to receive instructions on how to proceed with the appointment. If the Client wishes to proceed, the Photographer shall acquire written correspondence from the Client prior to proceeding.
    • The Photographer feels unsafe in or on the property due to, but not limited to the following - domestic arguments; hostility from homeowners, agents, neighbors, or workmen on site; dangerous or loose animals and/or pests such as fleas or bed bugs on site.

    If the Client is NOT present on photo location, the Photographer shall reach out to the provided contacts via phone call and text to show and advise of pending issues. If the Photographer does not receive a call or text back from the Client within 15 minutes, the Photographer shall maintain the right to reschedule the appointment and charge a $99 cancelation fee to the credit card on file. It is the responsibility of the Client to reschedule the canceled appointment.

  4. DAMAGE TO PROPERTY

    Home Snappers shall not be held liable for any negligence, damages, or any wrongdoing to personal artifacts or property on the part of its photographers and/or team members.

  5. PHOTOSHOOT SITE PREPARATION

    It shall be the Client's sole responsibility to ensure the property is ready for the photoshoot. Client shall ensure the property is in presentable condition, prior to photography.

    It shall be the sole responsibility of the Client to ensure personal property or artifacts are securely put away prior to the scheduled time of appointment.

    Photographers shall not be responsible for moving items, staging, cleaning, or tidying up a property or rooms within the property before, during, or after a booking.

    Home Snappers shall not accept responsibility for missing pets during a booking. Any and all pets should be secured for the duration of the photoshoot.

  6. DISCLAIMERS

    The accuracy and correctness of products delivered by Home Snappers shall be verified by the Client. Home Snappers shall not decide or authenticate the accuracy or correctness of floor plans, furnishing colors, furniture placement, or the correctness of any other item in regard to the dimensions, scale, actual layout, color accuracy of the images used to present the property.

    Home Snappers shall not and cannot guarantee taking photos of amenities and common areas at multi-family units, condominiums, and other such buildings since these often have restricted rules in regard to photography and video. However, an attempt shall be made to photograph the common areas and amenities if requested in writing at the time of booking, and that service will be added to the appointment's invoice.

  7. LIMITATIONS OF LIABILITY

    If for any reason a lawsuit occurs against Home Snappers, or any of its subsidiaries, affiliates, subcontractors, or employees; the maximum compensation for damages shall be the total amount but not greater than the amount paid to Home Snappers for its product or service.

  8. REFUNDS AND COMPLAINTS

    Home Snappers has a Satisfaction Guarantee policy. If Client is dissatisfied with the first shoot, the Client has the right to request a full or partial reshoot within 3 days from the date of delivery. If the Client is still dissatisfied after Home Snappers has attempted to rectify the issue, a full refund for the service in question shall be issued.

    If 3 days have passed without feedback from the Client, the Client is assumed to be satisfied. On the fourth day, the Client forfeits the right to request a refund or reshoot.

  9. Give-50-Get-50 REFERRAL PROGRAM

    All licensed realtors, real estate agents, and brokers are eligible to participate in the Home Snappers Give-50-Get-50 Referral Program. The referring party shall receive a $50 credit for each new, unique referral. The referred party must also be a licensed realtor, real estate agent, or broker in order to receive a $50 credit. Repeat referrers are eligible for the referral credit on an unlimited basis. Referral credits cannot be redeemed on another party's behalf.

  10. CREDITS

    Clients may receive a company credit for the following instances:

    • An active promo code is entered at the time of booking or provided prior to payment.
      • Promo code added via Booking Form shall be applied to that invoice.
      • Outstanding credits shall automatically be applied at checkout.
      • Credits shall not and cannot be applied after payment to receive a refund
    • Agent-to-Agent referral program shall receive $50 to both the referring and referred agents.
      Important: Homeowners are not eligible for this credit.
    • If the requested delivery window for their media has been missed. Expedited turnaround shall be downgraded to the next available delivery option with $20 credit if delivered on the due date and a full refund if delivery is greater than 48 hours late.
    • If services are not rendered after the invoice has been paid such as Drone photos in a no-fly zone.
    • If the invoice has not been paid, the service shall be removed from the final invoice prior to collecting payment.
  11. INTELLECTUAL PROPERTY

    Home Snappers is the copyright holder of all images. The copyright of an image is not transferred to any other party unless a specific written agreement is made. Licensing may be obtained for various applications of images.

    Home Snappers reserves all rights to registered trademarks, service marks, copyrights, and other intellectual property rights that may subsist in our website including text, illustrations, photographs, video, music, sounds, layout, designs, or source code.

    You cannot use, copy, modify, adapt, reproduce, store, distribute, print, display, perform, or publish any of our Intellectual Property except as expressly provided in an Agreement or with prior written consent from us. Any unauthorized use, dissemination, reproduction, or copying of these terms or any content on our website will be prosecuted to the fullest extent of the law.

  12. HOME SNAPPERS PRIVACY POLICY

    By using the Home Snappers website, you agree to and accept the collection and use of information in accordance with our policy and practices described.

    Collection and use of identifiable information.

    Home Snappers is the sole owner of all information collected on our website. This personally identifiable information may include but is not limited to Client names, email addresses, postal addresses and phone numbers, credit and debit card details, and PayPal account details.

    Home Snappers does not sell, trade, rent or otherwise share personal information to any third party outside of our organization other than as necessary to fulfill your request. Home Snappers will not collect any personal information of the Client's except when specifically, and knowingly provided when needed.

    Home Snappers shares Personal Information with vendors who are performing services for the Company, such as the servers for our email communications who are provided access to user's email address for purposes of sending emails from us. Those vendors use Personal Information only at our direction and in accordance with our Privacy Policy.

    Security: Home Snappers takes all necessary precautions to protect Client information that you submit to us. However, these measures do not guarantee that your information will not be accessed, disclosed, altered, or destroyed by breach of such firewalls and secure server software. By using our Service, you acknowledge that you understand and agree to assume these risks.

    Rights regarding your information: Clients have the right at any time to prevent us from contacting you for marketing purposes. When Home Snappers send a promotional communication to a user, the user can opt-out of further promotional communications by following the unsubscribe instructions provided in each promotional e-mail.

    Links to Other Websites: Our website contains hyperlinks to external websites, which are operated by third parties and are entirely independent of this site. Home Snappers are not responsible or liable for the content of these linked websites or for any hyperlinks contained on these linked websites. Please be aware that Home Snappers are not responsible for the privacy practices of such other sites. This privacy statement applies solely to information collected by the Home Snappers website.

    Policy Changes: The Company reserves the right to change this policy and our Terms of Service at any time. Clients should periodically check the website for updates.
